The expected ruling by Justice Bryan Sykes on an application by the prosecution for statements from the missing witnesses to be entered into evidence in the murder case involving Vybz Kartel did not happen.

Sykes was unable to make the ruling as the application, which is being made outside the presence of the 12-member panel of jurors, was not wrapped up as expected. 



As a result, Sykes sent home the jurors until next Tuesday, by which time the proceedings is expected to be concluded for him to make a ruling.

Several witnesses testified yesterday as the prosecution attempted to make its case for the statements to be read into evidence under Section 31(D) of the Evidence Act

The judge has asked the jury to be absent from court until next week Tuesday. During that time Justice Bryan Sykes will hear arguments from both prosecution and defense regarding a motion to have a witness statement be entered into evidence. Sykes will hand down his ruling by Monday.

The witnesses were cross-examined by Tom Tavares-Finson who, along with his son Chris, is representing Kartel; Michael Deans, the lawyer for co-accused Lenburgh McDonald; and Tamika Harris, who appears for Nigel Thompson.

Vybz Kartel, whose real name is Adidjah Palmer, Thompson and McDonald are being tried in the Home Circuit Court for the July 12, 2011 shooting death of Portmore, St Catherine, resident Barrington ‘Bossie’ Bryan.

Vybz Kartel and his co-accused lawyers are expected to challenge the prosecution motion.
